Boone Lake Club General Rules and By-Laws


SECTION A: FISHING RULES
1-A: The below listed species of fish and amounts allowed to be taken in one day per membership, guest permit or special fishing ticket shall be as follows:
BLUEGILL, SHELL CRACKERS: 15 per day, size none
CRAPPIE: 15 per day, size none
ROCK BASS (red eyes): 10 per day, size none
CHANNEL CATS: 3 per day, size none
RAINBOW TROUT 4 per day, size none
BASS (large or small mouth): 5 per day, size up to 12” and above 15” may be taken. all bass 12” to 15” must be returned to the lake. (Slot limit subject to change upon State recommendations.)
All other species subject to board approval – total bag limit on all combined species: 30 per day.
Taking frogs from the lake is PROHIBITED.
2-A: Fishing is restricted to members and their guests only, with the exception of the 5th District Special Olympics fishing tournament. Guests are permitted to fish with or without the member being present and must have a guest badge or special fishing ticket the member has purchased (Guests are not permitted to purchase guest badges or special fishing tickets). Members are responsible for the actions and conduct of their guests while at the lake. Guests are expected to follow the rules, regulations, By Laws and Articles of Incorporation (including Declarations of Covenants, Conditions and Restrictions) of Boone Lake Club, Inc. Children of members or guests 16 years and older must have a paid guest fishing badge or special fishing ticket to be permitted to fish. Each paid membership may purchase up to four guest badges annually for $25.00 each or a special fishing ticket for a fee of $10.00 for a 24-hour period before any guest may fish. Member must be in good standing in order to purchase either type(s) of fishing badges for their guest(s). Membership badge, guest badge or special fishing ticket must be displayed in full view at all times while fishing at Boone Lake, as specified by the Fish and Wildlife Department of Kentucky.
3-A: All members of Boone Lake Club, Inc. and their guest(s) must permit wardens to inspect their catch on stringers, in baskets, fish boxes and bags. No member shall have more than two days catch / guest(s) more than one day’s catch on stringers, in baskets, fish boxes and/or bags at any time. Wardens and all members to question or report to the Chief Warden any person fishing on the lake that does not display a membership badge, guest badge or special fishing ticket in full view.
4-A: Fishing is permitted only by rod and line. Hand line, trot line, gigging, noodling or bottle fishing are PROHIBITED. Only one hook per pole and line is permitted with the exception of artificial baits. Fishing poles and lines shall not be left in the lake overnight or when a member or guest(s) leaves Boone Lake property.
5-A: Carp or goldfish minnows are PROHIBITED for use as bait.

SECTION B: LAKE RULES
1-B: Bathing, swimming or wading for pleasure in the water at Boone Lake Club, Inc. is prohibited at all times.
2-B: All docks and landings are private property. Use by other members and/or their guest(s) by permission of the owner only. If the owner wishes to close their dock, they may do so.
3-B: Children are not permitted to play in boats, on docks or bridges at any time.
4-B: Domesticated fowl are not permitted on the lake without written permission of the Board of Directors.
5-B: Feeding of wild ducks and geese on Boone Lake or Homeowner’s property is prohibited.
6-B: Private use of any chemical in the Lake by any member or guest(s) is prohibited.

SECTION C: BOATING RULES
1-C: Only member’s boats are permitted on the lake and must not exceed their occupancy limits. Boats must be clearly numbered with the owner’s membership badge number. Life jackets or preservers must be provided for each boat passenger.
2-C: Boats may be used by Club members and their guests subject to Kentucky revised Statutes and regulations.
3-C: Gasoline engines are not permitted on Boone Lake and shall only be used on Boone Lake by the Lake Committee Members in the performance of their duties.
4-C: Children under 16 years of age must be accompanied by an adult escort while using a boat and must wear a life jacket at all times while in a boat.

SECTION D: HUNTING / TRAPPING RULES
1-D: No hunting will be permitted on Boone Lake Club, Inc. property or on members’ premises at any time. Any poachers found in violation of this rule will be turned over to the proper authorities.
2-D: Firearms are not permitted in the clubhouse. Per KRS 150.170, landowners may deal with nuisance wildlife through scare tactics, repellents, fencing and exclusion, or removal via shooting or trapping. Contact a KDFWR Law Enforcement Officer or Wildlife Biologist in your area for assistance.
3-D: Only licensed trappers by the Commonwealth of Kentucky are permitted to remove nuisance animals from Boone Lake Club, Inc. premises under the written direction of the Board of Directors. Members may set live traps only on their property for the purpose of nuisance control.
4-D: All weapons, including concealed carry licensed weapons, are prohibited in the Boone Lake Clubhouse including Club sponsored functions on Boone Lake property at any time, with the exception of law enforcement officers. Violators will be turned over to the proper authorities for prosecution according to Kentucky State KRS 237.110 (see Appendix). Also, membership will be automatically suspended for a minimum of six months – guest(s) will not be permitted to return to Boone Lake Club, Inc. property.

SECTION E: GENERAL CONDUCT RULES AND REGULATIONS
1-E: Be a sportsperson and respect the rights of others. Profane, abusive, disruptive and disrespectful conduct and language are prohibited at any meeting, Boone Lake Club, Inc. function or while acting as a representative of Boone Lake Club, Inc. Anyone in violation will be asked to leave and the appropriate action, if deemed necessary by the Board of Directors, will be taken.
2-E: The Club reserves the right to ask any guest(s) of a member to leave the Club premises for violation of Club rules. At least two Wardens shall inform the member of their guest’s misconduct and ask the guest to leave the premises immediately. If, after sufficient time has elapsed for the guest(s) to depart, and the guest(s) refuses, then the Wardens shall call law enforcement authorities and ask that the guest(s) be removed. Each member is responsible for their guests’ conduct and actions. Once a guest(s) has been removed, the guest(s) will not be allowed to return to Boone Lake until the member has petitioned the Board of Directors for permission to allow the guest to return. The Board shall act on the petition at the next regular meeting held.
3-E: All disturbing and loud noises must cease by 10:00 PM on weeknights (Sunday – Thursday) and 12 o’clock midnight on weekends.
4-E: Fires are allowed only in accordance with applicable laws; no unattended fires are permitted. All fires must be properly extinguished before leaving the burn site. Household trash should not be burned (Chapter 94 – see Appendix).
5-E: All household garbage must be in trash bags. Boxes must be broken down and placed in the dumpster provided and located by the community mailboxes. The dumpster is provided for Boone Lake Club, Inc. members. Non-garbage items must be taken to the dump and are the responsibility of the member to be disposed of properly. Construction materials and furniture are prohibited from being placed in the dumpster (member is responsible for hauling this type of trash to the dump). Grass clippings, leaves, trees and other lawn materials are also prohibited from being placed in the dumpster (member may put in the burn pile in the field or haul to the dump).
6-E: The Club trailer is available for use with Board of Directors / Grounds Chairperson written approval. A club member shall request to use the trailer in writing to the Board of Directors / Grounds Chairperson. The trailer can be used for one week at a time and must be emptied and returned in the same condition it was borrowed to avoid a fee equal to repairs if damage occurs. The trailer cannot be taken off Boone Lake Club, Inc. common areas.
7-E: Members must obtain annual written approval from the Board of Directors before bringing or storing recreational vehicles (RV’s and Campers) and/or tents onto Boone Lake Club, Inc.common areas. The use of unlicensed power-driven pleasure vehicles, including mini-bikes, shall not be permitted on Boone Lake Club, Inc. common areas including the leased road at any time, unless approved in writing by the Board of Directors. Licensed golf carts and ATV’s (Quad / Gator not mini-bikes or three-wheelers) are permitted to be used at Boone Lake Club, Inc. by MEMBERS ONLY; not guests or children. -licensed / insured members only -must be 18 years or older (members only – not guests or children) -must have proper safety equipment -posted speed limits must be obeyed (Guests and children are not permitted to operate any unlicensed / licensed power-driven pleasure vehicle on Boone Lake Club, Inc. common areas) The following must be completed prior to use at Boone Lake Club, Inc.: Must sign waiver; Must apply annually; Must provide proof of insurance and license to be kept on file by Secretary; Decal must be visible at all times; Must show safety equipment in working order (brake lights / headlights / horn). No off-road pleasure riding – must stay on the road unless performing work duties for the Club. No drinking or driving under the influence while operating a golf cart or ATV. Owner / operator (member) is responsible for any and all damages and injury while operating golf cart and/or ATV. Must yield to car traffic by pulling over to allow cars to pass through. Any member who violates any part of the rules or signed waiver agreement will have their privileges revoked. If the Board receives a complaint, the member(s) will be required to appear before the Board of Directors with the person filing the complaint. Appropriate action shall be taken by the Board of Directors and all decisions are final.
8-E: Private parking places of property owners are reserved for themselves and their guest(s). Parking of any commercial vehicle on Boone Lake Club, Inc. common areas must be approved in writing by the board of Directors. Parking is prohibited in the bus turnaround, dumpster area, in front of the garage and in front of or behind the mailboxes.
9-E: All domestic house pets (dogs, cats, birds, etc.) must be under the control of the member at all times. Dogs shall be on a leash and animal excrement shall be removed when walking or exercising dogs. Guests are not permitted to walk and/or exercise dogs on Boone Lake Club, Inc. common areas unless they are staying with a member at their residence or visiting on that day. (Guests are not permitted to use Boone Lake Club, Inc. common areas for the sole purpose of exercising / walking their dogs – violators will be referred to the Board of Directors for appropriate action to be taken). Animal Control will be notified of violations in accordance with Boone County Ordinances (see Appendix). Any damages done by members or guests pets to the property of others shall be the responsibility of the pet owner.
10-E: All damages to any private premises and adjacent private property shall be indemnified by the person responsible for the damage between the parties. However, any damage done to Boone Lake Club, Inc.common areas by a member or a guest(s) shall be the responsibility of the Club member and/or related parties. The Club will take the appropriate action to ensure all damaged property is restored to its original state.
11-E: All explosive fireworks (excluding: sparklers, smoke bombs, snakes and fountains) are prohibited at all times on Boone Lake Club, Inc. common areas or private member’s property, including the 4th of July and other special holidays
12-E: Speed limit is 15 miles per hour on roads to and around the lake.
13-E: Upon the death of a member, the Club shall send flowers or a memorial not to exceed $50.00. The member’s name will be put on the memorial (active members or previous members will be added that had a minimum of ten years membership at the discretion of the Memorial Committee).
14-E: The Boone Lake Clubhouse may be rented on a first come basis by its members only for private gatherings for $50.00 per day, plus a deposit of $100.00. All members renting the clubhouse  must sign the rental agreement. The deposit will be refunded following an inspection by the Entertainment/Fundraising Committee to insure that the clubhouse, pavilion and clubhouse property have been properly cleaned following the rental and all garbage disposed of by taking to the dumpster following the use within. If the clubhouse, pavilion and clubhouse common area have not been cleaned and the garbage properly disposed of, the cost of having it cleaned will be deducted from the deposit, with the balance, if any returned to the member. In the event the cleaning costs and/or damages exceed the amount of the $100.00 deposit, the balance of damages and cleaning costs will be billed to the member for payment owed to Boone Lake Club Inc. If the balance goes unpaid, a lien can be placed against the member’s real property (Boone Lake or non-Boone Lake) and a complaint will be filed with the Board of Directors by the Entertainment/Fundraising Chairperson and appropriate action shall be taken by the Board of Directors. • The keys to the clubhouse will be provided by the Entertainment/Fundraising Committee the day before the rental along with the rental agreement to be completed and signed by the Entertainment/Fundraising Committee and the member renting the Clubhouse, after the walk through has been completed. All monies are due at this time and checks made payable to Boone Lake Club, Inc. • The keys are to be returned to the Entertainment/Fundraising Chairperson by noon the day following the rental – an inspection (walk through) of the clubhouse, pavilion and Boone Lake common areas will be conducted by the Entertainment/Fundraising Committee at this time. • Directional banner can be placed by mailboxes.
14-E1: For non-clubhouse rental events, a deposit of $50.00 will be required for tables and/or chairs to be borrowed and will be returned to the member as long as the tables and/or chairs are returned in clean and same condition as when borrowed. If the tables and/or chairs are not returned in clean and same condition as when borrowed, the deposit will be forfeited, and the member will be responsible for replacing any broken or missing tables and/or chairs. In the event the cleaning costs and/or damages exceed the amount of the $50.00 deposit, the balance of damages and cleaning costs will be billed to the member for payment owed to Boone Lake Club, Inc. If the balance goes unpaid, a lien can be placed against the member’s real property (Boone Lake or non-Boone Lake) and a complaint will be filed with the Board of Directors by the Entertainment/Fundraising Chairperson and appropriate action shall be taken by the Board of Directors. ** Members and guests should refrain from interrupting private events and be respectful.

** BOONE LAKE CLUB, INC. BY-LAWS
BL~1: The name of the Club shall be Boone Lake Club, Inc., with headquarters in Boone County, Walton, Kentucky. The Club shall be a non-profit corporation. Membership in Boone Lake Club, Inc. shall be limited to 90 paying memberships. Cottage members’ badge numbers will coincide with address of property owned. Non-cottage members will be assigned badge numbers starting with a special series of numbers beginning with 70.
BL~2: The management and conduct of the business of the Club shall be vested in the Board of Directors. They shall develop such rules and regulations, adopted by the membership, governing the use of the grounds, the lake and the conduct of the members for the best interest of the Club and provide the greatest enjoyment for the members. This shall be in accordance with the Articles of Incorporation, Declarations and Covenants and Deed Restrictions, filed with the Commonwealth of Kentucky on February 19, 1998 (see Appendix).
BL~3: The Board of Directors shall consist of nine duly qualified members. Directors shall serve for a period of three consecutive years. By rotation method, three Directors having served three consecutive years are automatically eliminated. Each year three new Directors shall be elected to replace those who completed their three year term. Any member having served as a director for three consecutive years, and after a lapse of one year in retirement from serving as a Director of the Club, is again eligible and if nominated maybe a candidate for election as a Director of the Club. Any member in good standing shall be an eligible candidate: • After one year’s approved membership in the Club. • Has all dues and assessments paid current. • Has attended - monthly meetings when possible. • Follows the rules, regulations, By-Laws and Articles of Incorporation of Boone Lake Club, Inc. Any qualified member from the above guidelines can be nominated or volunteer to run as a candidate for the Board of Directors. Any Director not fulfilling their full term prior to the end of their three year term will not be eligible to be nominated as a candidate until one year from the end of their original elected term.
BL~4: Five or more Board Members shall constitute a quorum. In order to conduct any business of the regular open membership meetings and/or special closed Board of Director meetings. A quorum must be present and remain present during the conducting of business of all meetings.
BL~5: The Club’s business and operation are the affairs of the Club and their discussion and resolution of problems must be confined to the Board of Directors and its membership. The Board of Directors may authorize its President or committee chairperson to speak for the Club. This includes speaking to the Club’s attorney. Any person contacting the Club’s attorney by phone, e-mails, text, written communications or in person must have written permission from the President and two Directors of the Board. If anyone who contacts the Club’s attorney without written permission the Club’s attorney will bill that person directly. The membership may request to review the minutes from the regular monthly membership meetings (excluding all special board meeting minutes) and the Treasurer’s report by appointment only with one of the Officers of the Board of Directors, who must remain present during the entire appointment. Documents are not permitted to leave the clubhouse nor is it permissible for copies to be made. Recaps of the monthly membership meeting minutes are published in the monthly Topics . The Treasurer’s report is not distributed except at the monthly membership meetings.
BL~6: Regular open membership meetings of the Club shall be held on the last Sunday of each month at the Boone Lake Club, Inc. Clubhouse, Boone Lake, Walton, Kentucky, at 11:00 a.m. unless otherwise changed by the Board of Directors and announced to the membership two weeks in advance by posting a notice at the garage, in the Topics or via email to members. All regular open membership meetings shall be open only to members who are in good standing and special guest(s) of the board. Guests are not permitted to attend any Boone Lake Club, Inc. meeting. Children under 13 years old are welcome with proper supervision.
BL~7: Special closed Board of Director meetings may be initiated by the President and three Directors or by five Directors. Notice (written or oral) of a special meeting shall be given at least 24 hours in advance and this notice shall contain an Agenda of topics to be discussed. No additional items of business may be acted upon at a special closed Board of Director meeting. The minutes of special closed Board of Director meetings shall only be published and distributed to the Board of Directors.
BL~8: At the September meeting of each year, the Boone Lake Club, Inc. President shall appoint a Chairperson to nominate three candidates for Directors to be elected on the White Ticket. The membership shall at this meeting appoint a Chairperson to nominate three candidates for Directors to be elected on the Blue Ticket. Each Chairperson shall select a committee of three members to select the perspective candidates for Directors that will run for election on their respective tickets. At the October meeting, the Chairperson from the Blue Ticket and the White Ticket shall submit the names of their candidates. If either ticket cannot be filled for a total of six prospective candidates, and if there is a minimum of three prospective candidates then those perspective candidates shall run unopposed in the November election. If there is less than the minimum of three prospective candidates any existing Director(s) whose term is expiring may be eligible to be nominated for an additional term of three years. The Secretary shall prepare ballots listing the names of the candidates nominated in alphabetical order and listed under the insignia heading of their respective nominating committee and distribute a ballot to each member at least 20 days prior to the date of the election. Ballots will be counted at the November meeting. Any ballot shall be counted in the presence of the election officials of the annual election. Only members who have paid their dues and any other obligations owing to the Club shall be entitled to vote. The Chairperson of the nominating committees and four members appointed by the President, who are not running for office, shall act as tellers at the election. The three new Directors will take office as of January 1st of the following year. The membership present shall elect at the Open November Election Meeting the following officers from the nine Directors of the Board: President, Vice-President, Secretary and Treasurer. Any member of the Board shall be eligible for nomination from the membership present at the said meeting for election as an officer of the Club. The position(s) of Secretary and/or Treasurer need not terminate at the conclusion of any three-year term in office if the membership present so determines by majority vote at an open membership meeting. If the position(s) of the Secretary and/or Treasurer are not active Board of Directors then they shall have no voting powers at special closed Board meetings and have no voice to make motions or participate in the conducting of Board business. BL~8: (continued) The Secretary and Treasurer shall be two separate positions filled by two different members. If a member of the Board of Directors misses three consecutive monthly membership meetings that are an unexcused absence, he/she shall be automatically removed from the board and will be replaced. Their position will be filled by the candidate, in good standing, with the next highest vote from the previous election. In the event of a tie, a vote by membership will be the final decision. In the event that all eligible candidates from the prior election have been exhausted for filling a vacancy on the board, a member in good standing can be nominated and elected by the membership present at the current regular monthly meeting to fill the unexpired term. Excused absences will be determined and handled by the Board of Directors on a case by case basis. Given sufficient cause, any board member can be removed from the board by a 2/3 vote of the other board members.
BL~9: The President shall: • Preside at all regular monthly open membership meetings and special closed board meetings and at the annual meeting. In the President’s absence or his/her inability or refusal to act, the Vice-President shall preside with the full authority to act as necessary. If both the President and/or Vice President cannot fulfill the obligation of running the meeting, then the Secretary shall run the meeting. In the event the President, Vice-President and/or Secretary cannot fulfill the obligation of running the meeting, then the Treasurer shall run the meeting. In the event no officers are present, but a quorum of the Board of Directors is present, that quorum can select a Director as an acting President to conduct the monthly open membership meeting. • Be bonded in an amount to be determined by the board and have signing authority on the checking account. • Be a committee member of all standing committees. • Not have the authority to make motions or cast a vote unless it is to break a tie. • Initial and date the Secretary and Treasurer reports approved at each monthly open membership meeting that the Secretary is to maintain in the notebook that is to be made available for membership review. • Hold a special Board of Directors meeting prior to the regular January membership meeting to submit to the Board of Directors for approval of the Chairpersons for the various committees. • Appoint the Chairperson for each acting committee, with the approval of the majority of the Board of Directors, with the exception of the Finance and Budget Committee, which shall have the Treasurer as the Chairperson and the Board of Directors as the committee members. • The remaining committee members shall be appointed by the Chairpersons and approved by the majority of the Board of Directors.
BL~10: The Vice-President shall: in the President’s absence or his/her inability or refusal to act, preside over meetings with the full authority to act as necessary. When acting as President, the Vice-President cannot make a motion or cast a vote except to break a tie. Additional duties of the Vice-President include the following: • Serve as Co-Chair for the Finance and Budget Committees • Participate in the annual in-house audit • Conduct a monthly review with the Treasurer of the checks and invoices and confirm there are two signatures on the checks. • Review the monthly bank reconciliation and Treasurer’s report. • Audit the final dues paid report on or before May 1. • Confirm the annual tax returns have been filed.
BL~11: The Secretary shall: Keep the minutes of all meetings of the Board of Directors and monthly open membership meetings, take care of all correspondence, prepare and mail ballots and perform such other duties as may be prescribed by the Board of Directors. Record all monthly open membership meetings and Special closed Board of Director meetings; no other recording devices shall be operated in monthly open membership meetings or special closed Board of Director meetings. Anyone violating this rule will be asked to leave the meeting and will be referred to the Board of Directors for appropriate action. • Maintain all recorded meetings/club business which shall be kept in the safe deposit box (annually). • Be bonded in an amount to be determined by the board and have signing authority on the checking account. • Maintain current membership list including mailing address, phone numbers and e-mail addresses on all members. • Prepare minutes for the monthly open membership meetings to be read and approved at the regular monthly meetings. • Prepare minutes from special board meetings (not to be read or distributed to the general membership). • Attend any committee meeting when requested to record and keep minutes of said meetings. • Prepare and distribute annual membership badges/inserts and special guest badges.
BL~12: The Treasurer shall: • Receive and deposit in the bank, in the name of the Club, all funds belonging to the Club. • Pay all bills and obligations owing by the Club when the Board of DirecVs has approved the same. • Be bonded in an amount to be determined by the board and have signing authority on the checking account. • Prepare the monthly Treasurer Report for the monthly open membership meeting. • Prepare and mail annual membership dues statements. • Prepare the annual budget once approved by the Board of Directors. • Prepare and file any applicable state and federal annual tax returns. • Prepare the monthly reconciliation report. • Chair Finance and Budget Committee and conduct in-house audit annually. All securities and documents belonging to Club shall be kept in a safety deposit box of a bank designated by the Board of Directors and access to same can only be had by two of the three following officers: The President, Secretary and Treasurer.
BL~13: The Topics Editor of the Club’s newsletter “Boone Lake Topics” shall: • Be elected by the incoming Board of Directors at the November annual meeting. • Write, edit and distribute the Topics at their sole discretion. • Topics distribution by the 10th of each month to the Club membership.
BL~14: Each committee shall consist of a minimum of three or more members in good standing. The remaining committee members shall be appointed by the Chairperson and approved by the majority of the Board of Directors. The committees shall be responsible to the Board of Directors for carrying out their respective duties. The Chairpersons of these committees shall keep the Board of Directors apprised of their activities by submitting reports in writing or may appear in person at regular monthly membership meetings giving an oral report. No committee shall have the authority to bind Boone Lake Club, Inc., to any contracts, deeds, arbitrations or suits at law or any other action except as granted in writing by the Board of Directors. Committees may not expend monies in excess of $100.00 without prior Board approval. However, the Fish Committee and the Entertainment/Fundraising Committee may expend up to the appropriated amount set forth in the Club’s Annual budget. The Board shall describe the duties of all Committees. A copy of respective duties shall be given to the committee members when appointed. The Chairperson and their committee members shall sign the description of duties form and be filed by the Secretary once the chairperson and committee members have been approved by the Board of Directors. The Board may, at its discretion, appoint other committees to carry out specific duties. These Committees shall be referred to as Special Committees and their life and term of appointment shall not be longer than is necessary to perform the task assigned, or to the end of the annual year, whichever shall come first. There shall be 11 standing committees as follows: • Lake Committee • Grounds/Maintenance Committee • Dam Committee • Fish Committee • Membership and Real Estate Committee • Entertainment/Fundraising Committee • Long Range Planning Committee • Memorial Committee • Wardens • Fifth District Committee • Finance and Budget Committee BL~15: Prior to listing any Boone Lake Club, Inc. membership property for sale, it is the responsibility of said property owner to disclose the listing to the Membership and Real Estate Committee Chairperson so that the Rules and Regulations, By-Laws, Articles of Incorporation and Road Lease Agreement (where applicable) of Boone Lake Club, Inc. Membership can be given to the listing agent and all prospective buyers. Any person seeking membership, either as a prospective property owner (prior to closing on said property) or a non-cottage owner member, shall complete an application for membership which shall be prepared by the Club and signed by two members in good standing and be accompanied by an application fee of $50.00, which is non-refundable. All applications for membership shall be given to the Membership and Real Estate Committee. The Committee shall conduct a personal interview with the applicant. The Membership and Real Estate Committee shall give all persons seeking membership a current copy of Boone Lake Club, Inc. By-Laws, General Rules and Regulations, Road Lease Agreement (where applicable) and a copy of the Declarations of Covenants, Conditions and Restrictions prior to their personal interview. Upon completion of closing, a copy of the current deed is to be provided by the buyer (current member) to the Boone Lake Club, Inc. Secretary and is to be kept on file. Applicants shall be in attendance at the next monthly Club meeting after their interview and shall be introduced. The Membership and Real Estate Committee will give a full report to the Board of Directors and membership present at that time. If the Committee recommends approval, a majority of the members present must approve the application before the person seeking membership may become a member. Applicant shall not be added to the membership roster until all monies have been paid, including the current year’s membership dues. If a person applying for membership does so, prior to June 30, they will be required to pay the full amount of dues, whether it is as a property owner or a non-cottage owner, along with the $50.00 application fee. Any new applicant seeking membership after July 1 of any given year will pay one half of the annual dues of said year. Membership dues for property owners will be $500.00 per year. Membership dues for non-cottage owners shall be $400.00 per year. Any member owning more than one cottage shall pay one full membership by March 31st of each year, and the additional cottage membership dues can be paid in equal installments that are due on the 1st of each month, which shall continue in force until one or the other property is sold. Said monies shall be due and payable on or before the last day of March of each year. Any member, who is delinquent after March 31, and has not applied for or been granted a “Hardship,” will be charged an additional $50.00 annually on any outstanding balance.
BL~15: Continued Liens shall be filed on any balance for delinquent membership dues owed to Boone Lake Club, Inc. after March 31st at the direction of the Board of Directors. Legal actions to collect outstanding debts owed to Boone Lake Club, Inc. can be at the discretion of the board. Attorney(s) can be retained for this purpose. All members failing to pay dues as provided shall be deemed “not in good standing” of Boone Lake Club, Inc. In case of hardship, and upon written application to the Board of Directors submitted prior to March 31st of the year the dues are payable, an extension of time for payment of dues with a set payment plan may be granted by the Board of Directors. Any member who is not in good standing or whose membership has been suspended or lapsed will not be permitted to use another member’s fishing badges, or use club facilities, attend Club functions as a guest, including meetings or have voting privileges. Upon payment of yearly dues, two membership badges will be furnished per cottage for the current year. Members may purchase additional four guest badges for $25 each. Non-cottage members will be furnished with two membership badges upon payment of their dues and can also purchase four additional guest badges for $25 each.
BL~15A: Any child or grandchild, between the ages of 13 and 18 of a current Boone Lake Club, Inc. member can become Junior Members of Boone Lake Club, Inc. The Membership and Real Estate Committee will interview Junior Members in the presence of said members. There is no application fee for Junior Members. Junior members may attend Club Meetings and functions, voice their option and ask questions during club meetings, but have NO voting privileges. Annual fees for Junior Membership shall be $25.00. In January, following their 18th birthday, the Junior Member shall be placed at the top of the waiting list for non-cottage owner membership and will be exempt from the $50.00 application fee.
BL~16: Any member having complaints and/or grievances or an issue concerning the Club or its operation; or any member(s) or guest(s) of member(s) must submit the same to the Secretary of the Board in writing at least five days prior to any Board of Directors meeting. All decisions and findings by the Board of Directors will be final. The Board will consider each complaint / grievance on a case-by-case basis. Any member, board member, or Committee chairperson found violating the Rules and Regulations of Boone Lake Club, Inc. shall, under the direction of the Board, be notified in writing through certified mail by the Board Secretary of the specific violation or violations, setting forth a time, date and location that the member in violation and the complaining member(s) may appear and refute or explain their actions. If the member fails to appear, or if the Board of Directors, after due hearing of the member, considers the violation to be of sufficient magnitude to endanger the life, property, or infringe upon the rights of the Club or the membership, the Board shall take appropriate action. If the certified letter written by the Board Secretary is refused or cannot be delivered, the Board Secretary will then try to make contact with the member by telephone, e-mail or text.  If the Secretary cannot make contact on three consecutive days, the member will then be deemed unwilling to meet with the Board of Directors. If the member is deemed unwilling to attend and is not present at the next special board meeting, the member will then forfeit all rights to defend themselves as to any or all charges pending. At that time, the Board of Directors will continue actions deemed necessary concerning the charges against said member. The charges will be read out loud by the Secretary in the special board meeting. If present, the member being charged will have one last opportunity to defend themselves. The violating member shall have no recourse against the Board of Directors or Boone Lake Club, Inc.
BL~17: Any building / additions to Boone Lake Club, Inc. property are subject to the Boone County Building Code and regulations of the Club and must have prior approval of the Boone Lake Board of Directors. All new construction, including cottages and docks or additions to be added to such structures, shall be submitted to the Grounds Committee Chairperson and the Board of Directors for approval before submitting the same to Boone County Building Inspector for approval. However, unreasonable requirements and those in violation of building codes shall not be imposed by the Committee or Board. If approved, approval shall be granted as expeditiously as possible. No structure shall be placed closer than five feet to property lines and roadways and must be no closer than five feet to the lake shore line to allow for fishing. No new cottages or residential property may be erected unless on lake front property. Sewage, wash water or residue from cottages or other sources are not permitted to flow into or be deposited in the lake. Location of complete sewage systems must be in accordance with the existing sanitation codes. Each member will be responsible for keeping grass cut and keeping the property free of leaves, debris and discarded items. If found to be in violation by the Board of Directors, the member shall be notified in writing and further action shall be taken, as needed, according to Chapter 92 and 93 of the Boone County, KY code of ordinance (see appendix). It shall be the responsibility of the landowners to keep all structures in a good state of repair. Any structure deemed unsafe or in need of repair by the Grounds Committee shall be brought to the attention of the Board of Directors who will notify the owner in writing of the Grounds Committee findings and recommendations. If, after reasonable time, the owner has not cured the problem, the Board shall take action, according to Chapter 92 and 93 of the Boone County, KY code of ordinance. Lawn applications containing unnatural or toxic chemicals shall NOT be applied to ANY property at Boone Lake Club.
BL~18: Members are NOT PERMITTED TO LEASE OR RENT THEIR COTTAGES. However, they are permitted to have immediate family as sole occupants, with an additional paid non-cottage membership, when the deeded member does not physically reside at the cottage even if it is considered their legal residence. Relationship to deeded property owner must be verified. Non-family guests are not permitted to reside as sole occupants of any cottage at Boone Lake Club, if found in violation the deeded member shall be charged equal to a non-cottage membership for said guest. If guest is visiting for more than seven days as sole occupant, the deeded member must purchase a special guest permit at $25.00 per week per two guests. The deeded member must be in good standing to apply for special guest permit and submit a request form to the Board of Directors for approval prior to the visitation.
BL~19: In the event of the sale by any property owner to a non-member and said person is approved for membership, but the membership quota has been reached, the seller must relinquish their membership, but shall have the right to renew that membership when a vacancy occurs. If property is sold under a Land Contract and the resident of the land contract property does not pay his/her dues, the original seller/owner of the property will be responsible for said dues. A copy of the land contract must be submitted to the Secretary of the Board prior to the buyer occupying said cottage. If default occurs, the original seller/owner must notify the Board of Directors immediately in writing.
BL~20: Each billing or invoice must be approved by the Committee Chairperson for their respective committee. Except for the Fish Fund, any expenditure exceeding $1,000.00 which has been approved shall be made only after taking three bids, to be submitted to the committee for approval. The Committee has the right to accept or reject any or all bids to present to the Board of Directors for approval.
BL~21: These By-Laws, rules and regulations cannot be changed except by a written request submitted to the Secretary for Board review and signed by two members in good standing. The Board will review the written request and determine if the rule, regulation or by-law can be changed in accordance with the Articles of Incorporation. If the written request is approved by a majority of vote of the Board of Directors, the Secretary will present said request at the next open monthly membership meeting. The Editor of the Topics will publish in the next monthly newsletter. The Secretary will present said request at the next open monthly membership meeting to be voted upon by the membership.
BL~22: No sale of real estates owned by Boone Lake Club, Inc. shall occur except by vote of a majority of the members in good standing.
BL~23: In the event of the dissolution of Boone Lake Club, Inc. the assets shall be distributed in a manner consistent with KRS 273.303 and any Internal Revenue Service Regulations regarding non-profit corporations which may apply at the time of dissolution.
